NRW SemesterTicket - DeutschlandTicket

08.01.2024: Update on the nationwide semester ticket from the AStA

Temporary solution for interested students from 01 May:

- Students can purchase an upgrade ticket via an app.

- Download the app of a transport company and get the DeutschlandTicket upgrade for €12.33 per subscription. You only pay the difference between the DeutschlandTicket (€49.00) and the semester monthly fee (€36.67) = €12.33.

The subscription can be canceled at any time at the end of the month without further costs. To do so, the subscription must be canceled via the app by the 10th of the month in question at the latest. For students without a smartphone, there is no option to upgrade via alternative distribution channels.

From 1.5.2023, you can travel within the VRR and within NRW as usual with your university SemesterTicket. If you leave the federal state, in addition to the DeutschlandTicket upgrade, you may have to prove your student status during a check by showing your student ID and/or local SemesterTicket. In addition, the ticket inspector may ask you to present an official photo ID to verify your identity.

- It is an optional ticket, i.e. there is no compulsory purchase.

- Objective: A solidarity model for the SemesterTicket Deutschland will be developed together with all public transport and network partners

Do not transfer the difference to us! The amount will be refunded immediately.

The Minimum Wage Act (MiLoG) came into force on January 1, 2015.

The following information is intended to summarize the current status of the interpretation for you. However, we cannot offer binding advice or provide legal information.

Principle

In accordance with Section 1 MiLoG, every employee is entitled to payment of remuneration by the employer of at least the minimum wage (currently EUR 8.84 gross per hour).

Interns within the meaning of Section 26 of the Vocational Training Act are considered employees within the meaning of the MiLoG and are therefore generally entitled to the minimum wage.

Irrespective of the name of the legal relationship, an intern is a person who, according to the actual structure and implementation of the contractual relationship, undergoes a specific company activity for a limited period of time to acquire practical knowledge and experience in preparation for a professional activity, without this being vocational training within the meaning of the Vocational Training Act or comparable practical training (Section 22 para. 1 sentence 2 MiLoG).

Statutory exceptions to the minimum wage

In Section 22 MiLoG, the legislator has excluded certain groups of people from the scope of application of the MiLoG.

Interns and trainees

  • who are under 18 years of age and do not have a vocational qualification

Underage interns who have not completed vocational training are excluded from the minimum wage, as they are not yet legally considered employees.

  • who are doing a compulsory internship on the basis of a university regulation

Examples of this are internship semesters, practical phases or practical projects specified by the examination regulations. They are not subject to the minimum wage for the minimum duration stipulated in the examination regulations. Compulsory internships also include pre-study internships, which are admission requirements for studies in accordance with the examination regulations and must generally be completed before commencing studies.

In the event that the internship company requires corresponding proof of the compulsory internship, please contact the relevant examination office.

  • complete a voluntary internship of up to three months to provide orientation in choosing a career or course of study

An orientation internship usually takes place before choosing a degree programme. Registration is not required for this. Orientation internships after completing a degree course or apprenticeship should no longer be accepted, as the professional orientation phase will usually have been completed.(Source: Federal Ministry of Labor and Social Affairs (BMAS) brochure "Das Mindestlohngesetz im Detail", 5.1. 4.3.)

  • complete a voluntary internship of up to three months during their studies if they have not previously failed such an internship with the same apprenticeship provider

A study-related internship requires the intern to be registered at a university. It is irrelevant whether the Bachelor's/Master's degree has already been achieved or examinations are still outstanding. Exmatriculation after passing the Bachelor's/Master's examination takes place at the end of the semester in which the examination was passed.

There is no limit to the number of voluntary internships you can complete during your studies. However, they may not last longer than three months each, must take place with different employers and the purpose of the training should be clearly in the foreground.

A second internship without minimum wage with the same employer is only possible if it is a different type of internship. A compulsory or orientation internship can be followed by a three-month internship with the same employer during the course of study without being subject to a minimum wage obligation (source: Federal Ministry of Labor and Social Affairs (BMAS), brochure "Das Mindestlohngesetz im Detail", 5.1.3.4).

If a voluntary internship (orientation internship or study-related internship) lasts longer than three months, it is fully subject to the minimum wage obligation and must be remunerated with the minimum wage from the first day. This also applies if an internship initially limited to three months is extended (source: Federal Ministry of Labor and Social Affairs (BMAS), brochure "Das Mindestlohngesetz im Detail", 5.1.4.1).

Bachelor's/Master's theses in companies

On the question of whether the minimum wage applies in these cases, the Federal Ministry of Labor and Social Affairs (BMAS) states on its website der-Mindestlohn-wirkt under General questions on the minimum wage:

"The mere preparation of study-related theses (such as a bachelor's or master's thesis) or doctoral dissertations does not constitute an internship relationship, as the student does not undergo any operational activity in the company. Insofar as the student is not classified as an employee, there is no obligation to pay the minimum wage. However, the obligation to pay the minimum wage may exist if an (accompanying) internship has been agreed on the occasion of the thesis, in the context of which the student also works in the company, and there is no exception provided for under the Minimum Wage Act. Whether these requirements are met depends on the circumstances of the individual case."

Accordingly, a distinction must be made in each individual case as to whether the student is mainly occupied with writing their thesis at the company or whether they also provide other work services to the company, i.e. whether they are involved in the company's activities. In the first case, there would be no employment relationship between the student and the company and therefore no minimum wage would be payable.

Electronic student registration procedure from 01.01.2022

Electronic student registration procedure (SMV)

Proof of health insurance or exemption from compulsory insurance is required for admission to studies. This information is sent directly to us electronically by the statutory health insurance fund. According to § 199a SGB V, there is a mutual obligation to report health insurance between health insurance companies and universities. This electronic procedure replaces the paper procedure.

The health insurance companies report the following to the university

  • Insurance status (M10)
  • Start of insurance in the event of a change of health insurance provider (M11)
  • Delay in payment of health insurance contributions (M12)
  • Settlement of overdue health insurance contributions (M13)

The university notifies the health insurance companies of

  • Start of studies and date of registration (M20)
  • End of the semester in which or at the end of which the student is/was de-registered (M30)

The Hochschule Niederrhein will use the electronic student notification procedure to implement these reciprocal notification procedures from 01.12.2021 - notifications in paper form can then no longer be accepted.

Applications

We need an electronic notification from your health insurance company about your insurance status (M10) at the latest at the time of registration. Please contact your health insurance company - the sooner the better. Your health insurance company will then send us the required notification.

Please quote our sender number H 0000 354.

students

Students who are already registered do not need to pay attention to the changeover for the time being. The change will only affect you as soon as you change health insurance provider, for example.

Students who change their health insurance provider

To ensure that the next re-registration can take place smoothly, we need an electronic notification of the change of health insurance provider (M11) from your new health insurance provider.
Please contact your health insurance company - the sooner the better. Your health insurance company will then send us the required notification. Please quote our sender number H 0000 354.

Note for students who are privately insured or have private family insurance through their parents

Contact a German statutory health insurance company to be exempted from the obligation to pay contributions. Ask them to report your insurance status to us electronically using the registration reason M 10 for The Hochschule Niederrhein. Please inform the statutory health insurance company of our sender number H 0000 354.

The exemption from the statutory health insurance obligation is generally valid for the entire duration of your studies and can only be applied for at the beginning of your studies.

Students who are insured through the free health insurance scheme

Contact a German statutory health insurance company to apply for exemption from compulsory insurance. Ask them to report your insurance status to us electronically using the registration reason M 10 for The Hochschule Niederrhein. Please inform the statutory health insurance company of our sender number H 0000 354.

Letters or scanned evidence will not be accepted; the respective health insurance companies will send the reports directly to HSNR electronically.

Information for international students

Germany has concluded social security agreements with a number of countries, including the member states of the European Union and the European Economic Area. If you come from one of these countries and have statutory health insurance there, you can have this insurance cover recognized by a statutory health insurance fund in Germany. As a rule, you will need a European Health Insurance Card (EHIC) for this. You can apply for the EHIC free of charge from your health insurance company. Please contact a German statutory health insurance company upon registration and show them the EHIC. Ask the health insurance company to report your insurance status to us using the registration reason M 10 .

Our sender number is H 0000 354.

Information in English

NEW!
Electronic student notification procedure starting in January 2022

Applicants

On January 1, 2022 the new electronic student notification procedure of the statutory health insurance providers will come into force. This new electronic notification dialogue between the health insurance providers and the Hochschule Niederrhein enables paperless communication and sustainable optimization of the notification procedure. The health insurance card or a printed certificate of membership is no longer sufficient. We now need the digital confirmation of your health insurance when you enrol. Please contact your health insurance provider as soon as possible.

What will change?

  • during other activities for which the university is responsible, such as participation in excursions in Germany and abroad or revision courses
  • during visits to the library

What to do in the event of an accident?

Questions about liability and insurance

Sieglinde Ramlow-Papenfuß

Since January 1, 2018, the Maternity Protection Act has also applied to students if the university specifies the place, time and schedule of courses or if an internship is mandatory as part of their studies.

For those affected...

1. in accordance with § 15 of the Maternity Protection Act, you should inform the university of your pregnancy and the expected date of delivery as soon as you know that you are pregnant. If you are breastfeeding, you should also inform the university as soon as possible.

2. you are generally subject to the protection periods of § 3 of the Maternity Protection Act, i.e. the six-week period before and the eight-week period after giving birth. If you wish to attend courses or take examinations during the protection period, you must expressly declare this in writing to the university.

3. in accordance with § 10 of the Maternity Protection Act, the university must determine the risks to which you as a pregnant or breastfeeding student or your child are or may be exposed. Based on this risk assessment, it must decide whether and to what extent protective measures must be taken.

The Hochschule Niederrhein can, of course, only fulfill its obligations under numbers 2 and 3 if you have informed it of your pregnancy - as required by law.

After notification of the pregnancy...

We will contact you by e-mail to arrange an appointment (by telephone or in person).

During the meeting, we should clarify your personal study plans for the coming months. Possible risks can be narrowed down, specified or excluded from the outset.

Depending on the result of the preliminary clarification, a further appointment with the faculties may be necessary to find out whether and which specific risks exist or are to be expected. If the latter is the case, the university will take appropriate protective measures.

In any case, the university will offer you a meeting to discuss further adjustments to your study conditions.

In accordance with Section 14 of the Maternity Protection Act, the result of the risk assessment, the determination of the necessary protective measures and the aforementioned offer of a meeting will be documented and forwarded to the district government as the supervisory authority upon request in accordance with Section 27 (3).
